1. Definitions

“Client” means an individual and/or group of individuals who are over the age of eighteen (18) receiving services from Kin Flow, and/or an individual reading, and implementing e-resources or content from Kin Flow. 

"Kinesiology, Pranic Energy healing or Environmental Energetics ” does not mean medical treatment. While it may address specific and general conditions related to the Client’s life or profession, it does not constitute medical consultation or treatment by any means. Health Insurance, therefore, does not apply.

“Services” refers to (but not limited to) kinesiology, pranic energy healing, house space clearing, business space clearing, environmental energetics delivered by  Kin Flow. This includes one-on-one sessions, program(s), content, e-learning material, workshops and zoom kinesiology sessions.

 2. Terms of Use

2.1 Please read these terms and conditions (the “Terms”) carefully. By engaging Kin Flow or by making a purchase from us, you signify that you agree to these terms and conditions. 

2.2 Kin Flow reserves the right to modify this Agreement and/or the Policies (and update Kin Flow) Web Page on which they are displayed) from time to time. A date stamp will be applied at the top of the page therefore it is important that you check this page regularly.

3. Links

3.1 This Website, including associated social media profiles, may contain links to third party websites. The inclusion of a link does not imply that Kin Flow endorses, has investigated or verified the linked websites.
3.2 Kin Flow makes no warranty or representation concerning these links or the linked websites and you acknowledge that Kin Flow is not responsible for the functionality of these links, the security of such websites, the reliability or accuracy of the information contained on such websites, the copyright compliance, legality, decency, privacy policy, privacy practices or any other aspect of such websites.

3.3 You acknowledge that you enter any third party websites at your own risk. It is your responsibility to review any terms of use or privacy policies relevant to such websites.

3.4 All prices displayed of products advertised on the Website, can be changed without notice.

4. Bookings & Payment

4.1 Payment of services and/or products will be in Australian Dollars (AUD), and will be made via Direct Bank Deposit into a specified account of  Kin Flow or Square.

4.2 For all online bookings, upfront payment is required before an appointment is confirmed.

4.3 For all face-to-face bookings, payment will be made following the session. 

4.4 The Client agrees to pay Kin Flow for any additional expenses (including but not limited to incidental and out of pocket expenses). Such additional fees and charges which fall outside of scope will be communicated to the client, and approval will be sought. 

4.5 In the event  Kin Flow is required to recover any unpaid costs through an external agency: all legal costs involved with recovery will be paid by the Client, on an indemnity basis; and where the account is referred to a collection agency, collection costs associated with the collection agency will be added to the balance outstanding and will be paid by the Client.

5. Delays 

5.1 For sessions conducted online, both parties agree to be present at the scheduled time for the session booked. Where the Client wishes to reschedule, they will be required to do so with a minimum of 48 hours notice. 

5.2 Kin Flow shall not be liable for any failure or delay in supply or delivery of Services where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of  Kin Flow including but not limited to: war, strikes, lockouts, government restrictions, personal illness, transport delays, natural disasters, power outages, theft, accidents of any kind or act of terrorism.
6. Confidentiality   

6.1 The Client represents and warrants to Kin Flow that to the best of client’s knowledge, use of information provided by the client and the client content does not infringe the rights of any third party. 

6.2 All material considered strictly confidential by either party shall be designated as confidential. Parties are to exercise all reasonable acts to ensure this is kept confidential. 

7. Indemnity  

7.1 The Client agrees that they will not hold Kin Flow liable to them or anyone for any delays, errors, any loss, damage or cost, including, without limitation, any direct, indirect, special, purely economic, physical, mental, consequential or punitive damages arising out of, or in connection to the use of information or resources, or services provided to the Client by Kin Flow .You acknowledge that decisions are made on your own. The information provided by Kin Flow are intended to assist you in making a decision and does not in any way substitute professional advice. 

7.2 The Client agrees that they will hold Kin flow harmless from any and all claims, demands, liabilities, losses, damages, judgments or settlements, including all reasonable legal costs and expenses which may arise directly or indirectly as a result of any promise, representation, warranty, act, omission or obligation of  Kin Flow in respect of the:

(a)    provision of Services and/or content made available to the Client; and/or

(c)    any breach of these terms (or associated terms) by the Client.

8. Disclaimer: No Warranty or Guarantees 

8.1 Content on the website and services provided by Kin Flow are provided on an "as is" basis, and without any warranty or condition, express or implied. You consume this information at your own risk.

8.2 Kin flow agrees to use all reasonable efforts to provide the Services. You acknowledge and agree that nothing in this agreement shall constitute by Kin Flow an express or implied warranty or guarantee (a)  as to the outcomes that may be obtained from use of the Services; (b)  as to the accuracy, reliability or content of any information  provided through the Services. 

8.3 The Client acknowledges that there will be no guarantees and their success is dependent on their effort outside of the service(s) delivered by Kin flow . 

9. Refunds 

9.1 Pursuant to relevant Australian Consumer Laws, Kin Flow agrees to provide our services with due care and skill; and note that we meet a level of professional skill or knowledge to deliver the Services that we provide.

9.2 Where a Client feels that we have failed to meet Clause 9.1, they should contact us via emailing karaglen14@gmail.com where a remedy will be agreed to between parties.

9.3 Where the client wishes to cancel a booking and payment has been made, they are to email karaglen14@gmail.com as soon as practical. Rescheduling and/or refunds and cancellations will be offered to the client dependent on circumstances and will be at the discretion of Kara Glen Wellness.

9.4 Other cancellations and refunds will be at the full discretion of  Kara Glen Wellness. 

10. Dispute Resolution

If the Client has a complaint about the Service they have received from Kin Flow, please contact us directly through karaglen14@gmail.com Mediation will be the first cause of action, if communications between the Client and Kin Flow in an attempt to resolve the dispute has exhausted. 

11. Misunderstandings 

Where there are misunderstandings, or comments are made that upsets the Client, please let us know. We are committed to providing you with the service and support you need and believe at times, honesty and trust are critical and key for our relationship to grow. To foster an open and safe environment for the Client to come with confidence, it is important that the Client lets us know if there is anything the Client is concerned about. 

12. Copyright

Unless otherwise stated, the information, blogs, text materials, graphics, logos, button icons, video and audio clips, trademarks, advertisements, layout, arrangement, graphical user interface, look and feel, and control features of Kin Flow Website and or any of its Platforms are owned and controlled for these purposes by Kin Flow. You may not modify, rent, lease, loan, sell, distribute or create derivative works based on any of the Content (either in whole or in part) unless you have been provided with prior written permission by Kin Flow.

13. Data Security

13.1 Our site has been designed to protect the information that we collect online from unauthorised access. We take reasonable steps to safeguard your private information by implementing appropriate physical, electronic and managerial procedures necessary to protect your privacy. For your security, we may ask for identification on credit card purchases for high value transactions. In the event that any or any part of the terms or conditions of this Agreement shall be determined as being invalid, unlawful or unenforceable wholly or to any lesser extent, such term or condition to the extent that it is invalid, unlawful or unenforceable shall be severed from the remaining terms and conditions and the remaining terms and conditions shall continue to be valid and enforceable to the fullest extent permitted by law.

13.2By engaging Kin Flow for our services, and/or consuming our content, you acknowledge that you represent and warrant that you are over the age of eighteen (18) or have gained appropriate parental or guardian consent to engage Kin Flow Wellness for our services, that all registration information you submit is truthful and accurate.

14. Governing law and jurisdiction 

This agreement is governed by the laws of the State of Queensland, Australia. Each party will submit to the jurisdiction of the courts exercising jurisdiction there, and waive any right to claim that those courts are an inconvenient form.  

15. Law enforcement

Kin Flow reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting or sending any materials and/or content, which violate any applicable or relevant law.

16. Limitation of Liability, Disclaimers, and Assumption of Risk

The services provided as part of Environmental Energetics are intended solely for the promotion of well-being and balance within the environment and are not a substitute for medical, psychological, financial, or legal advice. Clients are advised to seek appropriate professional guidance for concerns in these areas. The provider makes no guarantees, representations, or warranties regarding the effectiveness, results, or outcomes of the services offered, as these can vary significantly from individual to individual.

By engaging these services, clients acknowledge that they fully understand the nature of the services and voluntarily assume all risks, both known and unknown, associated with their use. The provider shall not be held liable for any perceived or actual loss, damage, injury, or adverse effects, financial or otherwise, resulting from the use or application of these services. To the fullest extent permitted by law in Queensland and Australia, the provider expressly disclaims any liability for any direct, indirect, incidental, consequential, or punitive damages. The provider’s total liability, in any event, shall not exceed the total amount paid for the services provided.

Client Consent and Acknowledgment

By engaging the services of the provider, kin flow, clients confirm that they have read, understood, and agreed to these terms and conditions. Clients agree that they voluntarily participate and fully accept the risks associated with these services.

Retrospective Application of Terms

These terms and conditions shall apply to all services provided by the provider, kin flow, including any services that have been completed prior to the client’s receipt of this agreement. By continuing to engage in or having previously engaged the provider’s services, the client agrees to be bound by these terms and conditions, including for any sessions or services already rendered.
